SWEEPSTAKES DESCRIPTION: The Buick / GMC National Sweepstakes ("Sweepstakes") is offered on the internet and at select Buick and GMC events only in the fifty (50) United States and District of Columbia ("U.S."). Sweepstakes begins at 12:00 AM Eastern Time ("ET") on 8/31/09 and ends at 11:59 PM ET on 5/31/10 ("Sweepstakes Period").
SPONSOR: General Motors Company, 100 Renaissance Center, Detroit, MI 48265.
ADMINISTRATOR: Exposure Marketing, Inc., 1000 North Opdyke Rd, Auburn Hills, MI 48326.
ELIGIBILITY: The Sweepstakes is open only to legal U.S. residents who are at least eighteen (18) years of age or the age of majority in his/her state of residence, whichever is older as of date of entry ("Entrant"). Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of General Motors Company("Sponsor"), Lowe's®, Digitas LLC, GM R*Works, Exposure Marketing, Inc. ("Administrator") and their respective parent companies, subsidiaries and affiliates, distributors, dealerships and companies involved in the implementation and execution of the Sweepstakes (collectively the "Sweepstakes Entities") are not eligible. Sweepstakes is void in Puerto Rico, and other US Territories and jurisdictions (including overseas military installations) and where prohibited.
AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and the Administrator, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: There are three (3) ways to enter the Sweepstakes -
1) ONLINE - Visit www.GMC.com/lowes (the "Website") during the Sweepstakes Period, read and accept these Official Rules and follow the instructions to complete and submit the registration form ("Entry"). All registration information requested must be provided. ONLINE ENTRIES MUST BE SUBMITTED BY 11:59 AM EST on 5/31/10.
2) AT EVENTS - Complete an official entry form, available while supplies last at the sweepstakes display at any participating Buick or GMC-sponsored event (collectively, the "Events"; any one an "Event") during the Sweepstakes Period, and deposit in the entry box. EVENT ENTRIES MUST BE RECEIVED BY THE POSTED CLOSING TIME OF THE EVENT.
3) VIA MAIL - Complete an official entry form included in Sponsor direct mailings and mail to the address listed on the entry form in a first class stamped envelope. No mechanical reproductions permitted . MAIL ENTRIES MUST BE POSTMARKED BY 5/31/10 AND RECEIVED BY 6/7/10.
Limit: One (1) Entry per person or email address regardless of entry method. In the event more than one (1) Entry is received from any one person or email address, the first Entry processed will be considered the only valid entry received. Any attempt by an entrant to obtain more than the stated number of entries by using multiple or different email addresses or identities will void that Entrant's Entries and that Entrant may be disqualified. In the event of a dispute regarding online entry, Entries will be deemed made by the authorized account holder of the email address submitted at the time of Entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, on-line service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner may be required to show proof of being the authorized account holder. Use of any automated system to participate is prohibited and will result in disqualification. No mechanical reproductions of entry forms permitted. Sponsor is not responsible for late, lost, misdirected, or illegible Entries.
WINNER SELECTION AND VERIFICATION: The potential Grand Prize winner will be selected in a random drawing conducted on or about 6/15/10 from among all eligible entries received. Drawing will be conducted by Administrator, an independent judging organization. Potential winner will be contacted by the Administrator by telephone and email and will be required to complete and return an Affidavit of Eligibility and Liability Release and except where prohibited by law, a Publicity Release Form ("Affidavit/Release") within seven days of receipt. ELIGIBILITY OF GRAND PRIZE WINNER IS SUBJECT TO VERIFICATION BY THE SPONSOR AND/OR ADMINISTRATOR. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT HAS BEEN NOTIFIED THE ELIGIBILITY VERIFICATION IS COMPLETE. If prize is refused, the potential winner cannot be contacted, or fails to execute and timely return the Affidavit/Release (or any other required documents) within the required time periods, or is otherwise ineligible to receive the prize, an alternate winner will be selected. Except where prohibited by law, acceptance of a prize constitutes permission for Sponsor to use winner's name, hometown, likeness, statements and other personally identifiable information for promotional, advertising and marketing purposes in any media throughout the world without additional prize, incentive, consideration, consent or review; and upon request, winner will provide written consent to such use. Odds of winning depend on the number of eligible entries received .
ONE (1) GRAND PRIZE: Grand Prize package will consist of the following two (2) elements -
1) Winner's choice of any Current Model year Buick or GMC Vehicle - Approximate Retail Value ("ARV") not to exceed $66,125. ARV based on 2009 Manufacturers Suggested Retail Price of a base model. Grand prize vehicle excludes commercial vehicles. Winner is responsible for vehicle registration, license, title and insurance fees and for all costs associated with any available upgrade/option packages and any other expenses related to the acceptance and use of the prize not specified herein. Winner must take delivery of vehicle within 30 days of notice of availability from winner-selected Buick or GMC dealer near winner's residence, subject to Sponsor's approval. Winner must a have valid U.S. driver's license and proof of insurance to take delivery. Vehicle awarded may differ from any vehicle shown in promotional materials. Vehicle color, options and equipment will be determined by Sponsor in its sole discretion.
2) $10,000 Lowe's Gift Card - Gift Card is redeemable at any U.S. Lowe's retail location or online at www.lowes.com for merchandise and services only. Card is not redeemable for cash or valid as payment on Lowe's credit card and is subject to terms and conditions of Issuer.
Total ARV of Grand Prize is $76,125. Prizes may not be transferred or assigned. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion. Winner will be responsible for all taxes (not limited to federal, state, local and/or income) on prize and will be required to provide, to Administrator, his/her Social Security number for tax reporting purposes. Administrator will file an IRS Form 1099 with the Internal Revenue Service for the fair market value of a prize.
GENERAL CONDITIONS / RELEASE: By participating, Entrants (a) release Sweepstakes Entities, their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (b) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a prize including, but not limited to, its quality or availability, except in regard to Sponsor and the standard limited warranty for the prize vehicle. Neither Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of Entry information, or for any human or other error, technical malfunctions, lost/delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or Website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail, or any injury or damage to participant's or any other person's computer related to or resulting from participation in this Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Sweepstakes is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes which in the opinion of Administrator and/or Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Administrator reserves the right at its sole discretion to disqualify any suspect Entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes. In the event of any cancellation, termination or suspension, notice thereof will be posted at www.GMC.com/lowes and the determination of the Grand Prize winner will be made, from among all eligible, non-suspect Entries received as of the date of the termination, cancellation or suspension, as Administrator determines in its sole discretion. Entries not complying with all rules are subject to disqualification.
DISPUTES: Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan or the appropriate Michigan State Court located in Oakland County, Michigan; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will registrant be permitted to obtain awards for, and registrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan.

DESCRIPCIÓN DEL SORTEO: El Sorteo Nacional Buick/GMC (de aquí en adelante denominado el “Sorteo”) se ofrece en Internet y en ciertos eventos de Buick y GMC sólo en los cincuenta (50) Estados Unidos y el Distrito de Columbia (“EE. UU.”). El Sorteo comienza el 31 de agosto de 2009 a las 12:00 a. m., hora del Este (“ET”) y finaliza el 31 de mayo de 2010 a las 11:59 p. m., ET (“Período del Sorteo”).

ELEGIBILIDAD: El Sorteo está abierto sólo a residentes legales de los EE. UU. que tengan al menos dieciocho (18) años o la edad considerada como mayoría de edad en su estado de residencia (la que sea mayor) al momento de inscribirse (los “Participantes”). Los empleados, directores y funcionarios, y sus familiares inmediatos (cónyuges y hermanos/as, padres e hijos, yernos y nueras), así como los miembros del personal de General Motors Company (el “Patrocinador”), Lowe’s®, Digitas LLC, GM R*Works, Exposure Marketing, Inc. (el “Administrador”) y de sus respectivas empresas matrices, subsidiarias y filiales, distribuidores, concesionarios y empresas involucradas en la implementación y ejecución del Sorteo (colectivamente, las “Entidades del Sorteo”) no son elegibles. El Sorteo no tendrá validez en Puerto Rico, como tampoco en otros territorios y jurisdicciones de los EE. UU. (incluidas las instalaciones militares en el extranjero) donde esté prohibido.
ACEPTACIÓN DEL REGLAMENTO OFICIAL: Al participar en el Sorteo, cada Participante acepta completa e incondicionalmente este Reglamento Oficial y las decisiones del Patrocinador y el Administrador, que son inapelables y vinculantes en todos los asuntos relacionados con el Sorteo. Para ganar un premio es necesario que se cumplan todos los requisitos aquí establecidos.
CÓMO INSCRIBIRSE: Existen tres (3) formas de inscribirse en el Sorteo:
Límite: Una (1) Inscripción por persona o por dirección de correo electrónico, independientemente del método de inscripción. En caso de que se reciba más de una (1) Inscripción de alguna persona o dirección de correo electrónico, la primera Inscripción procesada se considerará como la única inscripción válida recibida. Cualquier intento por parte de un participante de inscribirse más veces que la establecida usando múltiples o diferentes direcciones de correo electrónico o identidades anulará todas las Inscripciones de ese Participante, y éste podrá quedar descalificado. En caso de disputa respecto de una inscripción en línea, se considerará que la inscripción fue realizada por el titular de cuenta autorizado de la dirección de correo electrónico enviada al momento de la Inscripción. El titular de cuenta autorizado es la persona física asignada a la dirección de correo electrónico por parte de un proveedor de acceso a Internet, un proveedor de servicio en línea u otra organización responsable de asignar direcciones de correo electrónico o el dominio asociado con la dirección de correo electrónico enviada. A un ganador potencial se le puede exigir que presente alguna prueba de que es el titular de cuenta autorizado. El uso de cualquier sistema automático para participar queda prohibido y resultará en la descalificación. No se permite ningún tipo de reproducción mecánica de los formularios de inscripción. El Patrocinador no es responsable de las Inscripciones que lleguen tarde, se pierdan, se envíen con una dirección equivocada o sean ilegibles.
SELECCIÓN Y VERIFICACIÓN DEL GANADOR: El ganador potencial del Gran Premio se seleccionará en un sorteo al azar entre todas las inscripciones elegibles recibidas, que se llevará a cabo el o alrededor del 15 de junio de 2010 y será conducido por el Administrador y una organización independiente que actuará como juez. El Administrador se comunicará por teléfono y por correo electrónico con el ganador potencial, quien deberá completar y devolver una Declaración Jurada de Elegibilidad y un Descargo de Responsabilidad y, excepto donde la ley lo prohíba, también un Formulario de Autorización de Publicidad (“Declaración Jurada/Descargo”) dentro de los siete días de su recepción. LA ELEGIBILIDAD DEL GANADOR DEL GRAN PREMIO ESTÁ SUJETA A VERIFICACIÓN POR PARTE DEL PATROCINADOR Y/O DEL ADMINISTRADOR. UN PARTICIPANTE NO SERÁ GANADOR DE NINGÚN PREMIO SALVO Y HASTA QUE SE LE HAYA NOTIFICADO QUE SE HA COMPLETADO LA VERIFICACIÓN DE ELEGIBILIDAD. Si el ganador potencial rechaza el premio, si no es posible contactarlo, o si no cumple con las formalidades y no devuelve oportunamente la Declaración Jurada/Descargo (o cualquier otro documento requerido) dentro de los plazos requeridos, o si por algún otro motivo no es elegible para recibir el premio, se seleccionará un ganador alternativo. Excepto donde la ley lo prohíba, la aceptación de un premio constituye un permiso para que el Patrocinador utilice el nombre, la ciudad, la imagen, declaraciones y demás información que identifique personalmente al ganador para fines de promoción, publicidad y marketing en cualquier medio de difusión del mundo, sin mediar ningún premio, incentivo, consideración, consentimiento o revisión adicional; y, si así se le solicitara, el ganador proporcionará un consentimiento escrito para tal uso. Las probabilidades de ganar dependen de la cantidad de inscripciones elegibles que se reciban.
UN (1) GRAN PREMIO: El paquete del Gran Premio consistirá en los siguientes dos (2) elementos:
El ARV total del Gran Premio es de $76,125. Los premios no son transferibles ni asignables. No se hará ninguna sustitución por dinero en efectivo ni de otro tipo, salvo que así lo decida el Patrocinador, quien se reserva el derecho de reemplazar un premio en su totalidad o en parte, por otro premio de valor comparable o superior si el premio estipulado no estuviera disponible por algún motivo, según lo determine el Patrocinador a su sola discreción. El ganador será responsable de todos los impuestos (sin limitarse a los federales, estatales, locales y/o a la renta) sobre el premio y deberá proporcionar al Administrador su número de Seguridad Social para fines de declaración impositiva. El Administrador presentará un Formulario IRS 1099 al Servicio de Impuestos Internos (IRS, por sus siglas en inglés) por el valor de mercado justo del premio.
CONDICIONES GENERALES/DESCARGO: Al participar, los Participantes (a) liberan a las Entidades del Sorteo y a sus respectivos directores, funcionarios, agentes y empleados de cualquier y toda responsabilidad por demandas, costos, lesiones, pérdidas o daños de cualquier tipo que pudieran surgir a causa de su participación, incluidos el acceso no autorizado o ilegal a información confidencial o de identificación personal, o la aceptación, el uso o el uso indebido del premio; y (b) reconocen que dichas partes no han asumido ni asumen ninguna responsabilidad por ninguna garantía o representación, expresa o implícita, de hecho o de derecho, relacionada con un premio, incluidas (pero sin limitarse a) la calidad o disponibilidad del mismo, salvo en relación al Patrocinador y a la garantía limitada estándar por el vehículo del premio. Ni las Entidades del Sorteo ni ninguno de los proveedores de servicios son responsables de la trascripción incorrecta o inexacta de la información de la Inscripción, ni de ningún error humano o de otro tipo, desperfecto técnico, pérdida o demora en la transmisión de datos o de voz, omisión, interrupción, eliminación, defecto, falla en la línea de la red de telefonía, equipo de computación o software, ni de la incapacidad de acceder a un servicio en línea o sitio web, o de completar una llamada telefónica o una transacción por fax, ni de ningún otro error o mal funcionamiento, como tampoco de ninguna demora, pérdida o error en la correspondencia postal, ni de ninguna lesión o daño a la computadora del participante o de otra persona en relación con, o debido a, la participación en este Sorteo. PRECAUCIÓN: CUALQUIER INTENTO POR PARTE DE UN PARTICIPANTE O CUALQUIER OTRA PERSONA DE DAÑAR DELIBERADAMENTE CUALQUIER SITIO WEB, ALTERAR EL PROCESO DE INSCRIPCIÓN O MENOSCABAR DE OTRO MODO EL FUNCIONAMIENTO LEGÍTIMO DEL SORTEO, PUEDE CONSTITUIR UNA VIOLACIÓN DE LAS LEYES CIVILES Y PENALES Y, EN CASO DE PRODUCIRSE TAL INTENTO, EL PATROCINADOR SE RESERVA EL DERECHO DE COOPERAR EN LA INTERPOSICIÓN DE UNA ACCIÓN JUDICIAL CONTRA TALES PERSONAS Y DE EXIGIR LAS REPARACIONES CORRESPONDIENTES HASTA EL MÁXIMO PERMITIDO POR LA LEY. El no exigir la aplicación de algún término de este Reglamento Oficial no constituye una renuncia a dicha disposición. Si por alguna razón el Sorteo no pudiera llevarse a cabo según lo planeado, o si alguna infección por virus informático, bug, alteración, intervención no autorizada, fraude, acción de los participantes, falla técnica u otras causas, en opinión del Administrador y/o del Patrocinador, corrompieran o afectaran la administración, seguridad, imparcialidad, integridad o realización apropiada de este Sorteo, el Administrador se reserva el derecho, a su sola discreción, de descalificar cualquier Inscripción o Participante sospechosos, y de cancelar, finalizar, modificar o suspender el Sorteo. En caso de cancelación, finalización o suspensión, se publicará el aviso correspondiente en www.GMC.com/lowes y el ganador del Gran Premio se elegirá entre todas las Inscripciones elegibles no sospechosas recibidas hasta la fecha, según lo determine el Administrador a su sola discreción. Las Inscripciones que no cumplan con todas las reglas estarán sujetas a descalificación.
DISPUTAS: Los Participantes aceptan que (a) cualquier y toda disputa, demanda y causa de acción que pudiera surgir de, o en relación con, el Sorteo o el premio otorgado, se resolverá individualmente, sin recurrir a ningún tipo de demanda colectiva, y exclusivamente en el Tribunal del Distrito Este de Michigan o en el Tribunal del Estado de Michigan correspondiente, en el condado de Oakland, Michigan, Estados Unidos; (b) cualquier y toda demanda, juicio e indemnización se limitará a los costos de bolsillo reales incurridos, incluidos los costos asociados con la participación en este Sorteo, pero en ningún caso los honorarios de abogados; y (c) bajo ninguna circunstancia se le permitirá al Participante obtener indemnizaciones por, y por la presente el Participante renuncia a todo derecho a presentar reclamos por, daños punitivos, incidentales o consecuenciales, ni de ningún otro tipo, más que los gastos de bolsillo; como también renuncia a todo derecho a que el monto de los daños se multiplique o incremente de otro modo. ALGUNAS JURISDICCIONES NO PERMITEN LAS LIMITACIONES O LA EXCLUSIÓN DE RESPONSABILIDAD POR DAÑOS INCIDENTALES O CONSECUENCIALES, DE MODO QUE LO ANTERIOR PUEDE NO APLICARSE A SU CASO. Todas las controversias y dudas respecto de la interpretación, validez y aplicabilidad de este Reglamento Oficial, de los derechos y obligaciones del Participante, o los derechos y obligaciones del Patrocinador en relación con el Sorteo, estarán regidas por, y se interpretarán de acuerdo con, las leyes del Estado de Michigan, sin dar efecto a reglas de conflicto de leyes o de elección del derecho aplicable (ya sea del Estado de Michigan o de cualquier otra jurisdicción), lo que ocasionaría la aplicación de leyes de otra jurisdicción distinta del Estado de Michigan.

DIVULGACIÓN DEL CONSUMIDOR: Usted aún no ha ganado. Para participar de o ganar este sorteo, no hay obligación de compra o pago de ningún tipo.
